Introduction

We recognise the importance of maintaining the privacy of the information belonging to you (the "User"). This Policy sets out details of how we treat user information we collect on the "App". The App is owned and operated by Taken App Private Limited, a limited liability company incorporated under the Indian Companies Act, 2013 and having its registered office at 5th Cross, 30th Main, HSR Layout, 1st Sector, Bangalore, Karnataka 560 102 (the "Company").

By visiting and/or using the App, you agree to the terms of this Privacy Policy and it shall be deemed that you have read in full, accepted and agreed to the terms herein. The Company reserves the right to modify the terms contained in this Privacy Policy at any time by posting such modifications on the App. The modified Privacy Policy would be effective from the date of modification posted by the Company on the App. If you do not agree to any term contained in this Privacy Policy, please immediately cease your use of the App.

This Privacy Policy is intended to be compliant with the requirements set out in the General Data Protection Regulations issued by the European Union (the "GDPR") to the extent applicable.

Information that is collected by the Company on the App shall be used by the Company only for the purpose of providing the Services (as defined below), and such information shall not be used, sold, transferred or rented in a manner that is not set out in this Privacy Policy.

Information Collected by the Company

In providing the various services that are available on the App (the "Services"), the Company may have to collect certain personal information from you.

Active Collection

This refers to the information that is actively provided by you while registering on the App, while browsing on the App, while requesting for a demo or other information on the App or while making payments using the payment gateway on the App etc. This would also include information relating to yourself (such as your interests and preferences, kind of people you would like to meet via the App etc.) that you would be providing on the App to avail the Services. Such information may be provided in writing, or via audio / video clips.

Passive Collection

This refers to the information that is gathered by the Company using tracking code technology, browser cookies etc. for collecting information about your usage of our App. This information may be used by the Company for internal research to understand User demographics, interests and behaviour with a view to improving the functionality of the App. This information may include the URL of the website that you visited just before visiting the App or which one you go to after visiting the App, your computer browser information, and your IP address.

Contact Information

If you contact us directly, we may receive information about you such as your name, email address, phone number and the contents of the message. When you register on the App, we would also receive any chats, photo, audio or video recording and/or attachments you may share on the App, and any other information you may choose to provide such as information regarding your career, bio, education etc.

Photo Verification

We may ask you to upload a photograph at the time of your registration on the App to ensure that there are no fake or multiple accounts. This also helps us avoid fraudulent use of the App. The App might also collect ID proofs to verify age, which shall be deleted immediately after verification.

Sexual Orientation / Preference

You would be sharing your gender identity, sexual orientation and preferences with us so as to enable us to provide you the Services.

Interactions with Other Users

We process your chats and interactions with other users of the App so as to keep the Services and its use safe for all. These interactions would also be subject to our policy on moderating content on the App.

Testimonials

We may run surveys for research purposes and may contact you to find out if you would like to take part in them. Such surveys and marketing campaigns are optional.

Other Information

While you use the App, the Company may collect information about your IP address, MAC ID and the browser you are using as well as timestamps.

Passive Collection of Data

The Company follows a standard procedure of using log files. The information collected includes internet protocol (IP) addresses, browser type, ISP, date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any personally identifiable information.

With your consent, we collect your geolocation (latitude and longitude) from your device, in order to show real users around you.

Data Retention

Any information provided by you on the App is provided voluntarily and at your own risk. We store the information for as long as you are a User and/or as necessary to fulfil the purposes for which it was collected, to provide Services, resolve disputes, pursue legitimate business purposes, enforce agreements, prevent fraud, and comply with applicable laws.

Even if you delete your account, the Company may retain your information for a short period until it can be removed from servers and for compliance with legal obligations.

You shall be responsible for the accuracy of information provided. For any changes, notify the Company at support@taken.today.

To discontinue use of the App or withdraw consent, notify the Company at support@taken.today.

User Rights

You can request to receive an exported file of personal data we hold about you. You can also request that we rectify or erase any personal data. Please send your request to support@taken.today.

Use of Your Personal Information

We encourage you to consider carefully what information you disclose on the App. We do not recommend putting sensitive data such as email addresses, phone numbers, credit card details on your profile.

Processing of Data

Additional Information for California Users

"Personal Information" has the meaning given in the California Consumer Privacy Act of 2018 ("CCPA"). We do not sell your personal information. We use it for internet-based targeted advertising of our own services. We do not offer financial incentive programs.

Security of Your Information

The Company discloses personally-identifying information only to employees, contractors, and affiliated organizations that need to know it to process transactions or provide Services, and that have agreed not to disclose it. We take all measures reasonably necessary to protect against unauthorized access, use, alteration, or destruction.

However, no security measures are perfect or impenetrable. Neither the Company nor any of its employees would have access to the password relating to your User account. You are solely responsible for protecting your login credentials.

Cookie Policy

The Company uses traffic log cookies to identify which pages are being used. This helps analyse data about web page traffic and improve the App. This information is used only for statistical analysis and then removed.

The Company does not have control over cookies placed by third party links on the App.

Third Party Sites

If you click on third party links available on the App, you may be taken to websites the Company does not control. This Privacy Policy does not apply to those websites.

Social Media Features

The App includes Social Media Features such as WhatsApp and Facebook buttons, Google Logins and Apple Logins. These may collect your IP address and set cookies. Your interactions with these features are governed by the privacy policy of the entity providing them.

Our Policy Toward Children

The Services are available to persons over the age of eighteen (18) years. Persons below 18 shall not be entitled to use the App or Services unless through a parent or legal guardian's account.

Redressal of Grievances

If you have questions or grievances, reach out to us at support@taken.today (the "Grievance Officer"). Complaints will be acknowledged within 24 hours and addressed within 15 days.

Miscellaneous Provisions

Force Majeure: The Company shall not be responsible for any cessation, interruption or delay due to natural disaster, war, pandemic, terrorism, labor strike, lockout, or boycott.

No Waiver: A delay or failure to exercise any right will not constitute a waiver.

Governing Law

This Privacy Policy is governed by Indian laws. This App originates from Karnataka, India. By using this App, you consent to the jurisdiction of the courts in Bengaluru, Karnataka.
